Criminal Law--Street Solicitation, HRS 712-1207
In State v. Espinosa, I was the trial attorney (public defender). Mr. Espinosa was charged with street solicitation. During trial, I argued that based on the plain language ("in return for a fee"), the... however, based on the inclusion of the phrase "in return for a fee", it appeared obvious that legislature intended not to punish the patron, but only the person offering to engage in sexual conduct.
